According to US justice, Amazon is liable in case of defective product from third vendors



The decision by the US Court of Appeals could have serious consequences for Amazon, whose marketplace is a major part of its business. 

This is a court decision that may not please Amazon. The third Federal Court of Appeals in Philadelphia, USA, issued a ruling this week stating that the e-commerce giant is held responsible for defective products from third-party sellers who pass through its marketplace.

Amazon was successful at first


This decision is contrary to that of a lower court, following a complaint by Heather Oberdorf. The latter had been injured in the eye and had lost her glasses after being attacked by a dog whose leash, sold in the marketplace of Amazon, was defective and broke. 

The victim sued Jeff Bezos' firm in 2016, but was unsuccessful, as the court was based on Pennsylvania law in the matter.

Products sold by third parties, a major activity for Amazon


So inevitably, the decision taken on appeal, directed this time against Amazon, could eventually have important consequences. Nearly half of the items sold by the American giant come from third-party sellers. They can sell their goods on the company's website and store their products in their warehouses. In the last quarter, this single branch has returned $ 11 billion to Amazon. 

For now, Amazon has not officially reacted. The case will be remitted to the lower court, which will have to confirm the thesis defended on appeal. In which case, this could constitute a capital jurisprudence in the recent history of society.
