The proposed law to protect France's defense and national security interests in the context of the operation of mobile radio networks, known as the " 5G Law " or " Huawei Law ", entered the last phase before its final adoption. After the positive vote of the National Assembly on April 10 and first reading in the Senate on June 26, the Sages of the room presided over by Gérard Larcher definitively adopted the conclusions of the mixed joint commission, Wednesday, July 24th.
A law that implicitly disadvantages Huawei
After the Senators and MPs have reached an agreement on this famous Huawei law, things will obviously change for the equipment manufacturers, and in particular, you will understand, for the Chinese giant. Implicitly, and without quoting Huawei once, the text plans to limit the influence of the Shenzhen firm on the deployment of fifth-generation technology equipment.
Huawei seems to be paying long-standing suspicions, initially from the United States, who accuse the company of being a spy in the service of the Chinese government. The latter is thus suspected, by this means, of being able to freely exploit the data of the users who pass through the equipment of the firm of the Middle Kingdom.
Prime Minister will be able to decide
The law imposes an unprecedented measure for equipment manufacturers. From now on, they will have to obtain an official authorization from the Prime Minister or his services, if they want to deploy their software and equipment 5G on the territory. The initial bill was motivated in part by the risk of technology for network security.
Mobile operators will have to submit their official request to the Prime Minister, who will then have two months to address his response. The law provides that once granted, the authorization will be valid for a maximum of eight years. It may be refused by the State if it "considers that there is a serious risk of prejudice to the interests of defense and national security. " If the contours and the list of equipment covered by the law have not been specified, the law provides that any breach will be punished by five years of imprisonment and 300,000 euros fine.
